Terms of Service

1. Acceptance of Terms

By accessing or using the HomeSwipr website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. HomeSwipr ("we," "us," or "our") reserves the right to update these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

HomeSwipr is a web-based home discovery platform for Southern California homebuyers. The Service allows users to browse residential property listings through a swipe-based interface, save liked homes, set search preferences, and request property tours. Property listing data is sourced from third-party APIs, including Realtor.com and Zillow. The Service is hosted on Vercel and uses Supabase for authentication and data storage.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features of the Service, you may sign in using your Google account through our Supabase authentication integration. By signing in, you agree to:

  • Provide accurate and current information associated with your Google account
  • Maintain the security of your account credentials and not share access with others
  • Accept responsibility for all activity that occurs under your account
  • Notify us promptly if you suspect unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Tour Requests

The Service allows you to submit requests to tour properties. When you submit a tour request, you provide your name, email address, and phone number. By submitting a tour request, you acknowledge and agree that:

  • Your contact information will be shared with the listing agent or a partnered buyer's agent for the purpose of scheduling your tour
  • The agent may contact you by phone, email, or text message regarding your request
  • HomeSwipr does not guarantee tour availability, response times, or the conduct of any real estate agent
  • Tour requests do not constitute a binding agreement to purchase or lease any property

6. Property Listing Data

Property listings displayed on the Service are sourced from third-party data providers, including Realtor.com and Zillow APIs. You acknowledge and agree that:

  • Listing information, including price, availability, photos, and property details, is provided by third parties and may not always be accurate, complete, or current
  • HomeSwipr does not independently verify listing data and is not responsible for errors, omissions, or inaccuracies in third-party content
  • A property's appearance on the Service does not guarantee its availability for sale or tour
  • You should independently verify all property information before making any purchase or investment decision

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Scrape, crawl, or use automated means to extract data from the Service without our prior written consent
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Submit false, misleading, or fraudulent information, including fake tour requests
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Service to harass, abuse, or harm another person, including real estate agents
  • Reproduce, distribute, or create derivative works from the Service or its content without authorization

8. Intellectual Property

The Service, including its design, logos, text, graphics, software, and other content (excluding third-party listing data), is owned by or licensed to HomeSwipr and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. Third-party listing data and images remain the property of their respective owners.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY PROPERTY LISTING DATA.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMESWIPR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless HomeSwipr and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Third-Party Services

The Service integrates with and relies on third-party services, including Google (authentication), Supabase (data storage), Vercel (hosting), Realtor.com, and Zillow (listing data). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 8 through 13 of these Terms shall survive termination.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeSwipr regarding your use of the Service and supersede all prior agreements and understandings.
